Newfoundland and Labrador PHIA

Applies to: Custodians of personal health information in Newfoundland and Labrador.

The Personal Health Information Act expects that records may be kept outside the province. A custodian's policies must cover the collection, storage and transfer of information "whether within or outside the province" (s. 13(1)), and must "protect the confidentiality of personal health information that will be stored or used in a jurisdiction outside the province" (s. 13(2)(c)).

Disclosure to a person outside the province is allowed only in listed cases, such as with the individual's consent or where the Act or regulations permit it (s. 47(1)). A custodian that uses an information manager needs a written agreement that protects the information (s. 22(1)-(2)), and the custodian keeps its obligations for information given to the manager (s. 22(6)).

What to check in a listing

  • If the data is stored outside the province, do your policies cover it? (Storage)
