Manitoba PHIA

Applies to: Trustees of personal health information in Manitoba (the Act's word for health custodians).

The Personal Health Information Act does not say where records must be stored. A trustee may give personal health information to an information manager "for the purpose of processing, storing or destroying it or providing the trustee with information management or information technology services" (s. 25(1)).

The trustee needs a written agreement that protects the information as the regulations require (s. 25(3)). Information held by the information manager "is deemed to be maintained by the trustee" (s. 25(5)), so the trustee stays responsible for it.

Cabinet may make regulations governing disclosure to persons or bodies outside Manitoba (s. 66). The Personal Health Information Regulation (245/97), current to 2026-10-14, contains no rule on storage or disclosure outside Manitoba.
