British Columbia
British Columbia FIPPA
Applies to: Public bodies: ministries, health authorities, school districts, municipalities, universities.
BC repealed its data-residency requirement in 2021. A public body may now disclose personal information outside Canada "only if the disclosure is in accordance with the regulations" (s. 33.1).
The regulation requires a supplementary assessment inside the privacy impact assessment whenever sensitive personal information is disclosed to be stored outside Canada; the public body then makes a risk-based decision. Temporary processing outside Canada is allowed under s. 33(2)(u).
